Arizona DUI Penalties

The penalties for conviction of a DUI in Arizona vary based on circumstance but there are general state sentencing guidelines that judges are given to abide by. Keep in mind these numbers are based on the blood test results, not breathalyzer results, so you may have to wait several weeks after your arrest for blood tests before you know what you’re being charged with.

Here are the Arizona DUI Penalties set forth by the Arizona Department of Justice and the Motor Vehicle Division which handles it’s own penalties in relation to your driving privileges:

DUI First Offense or BAC above .080

All DUI convictions in Arizona require minimum jail time of one day. If you have been convicted of a first time DUI the penalties are as follows…

Jail Time: 10 days in jail with the possibility of 9 days suspended upon successful completion of alcohol screening and submission to treatment.

Fines: $250 Base Fine plus $500 for Prison Assessment and $500 for Public Safety.

Driving Privileges: Minimum of 90 days License Suspension. After 30 days you may be eligible for a Restricted License if you successfully complete alcohol screening.

Alcohol / Drug Screening and Treatment based on assessment results.

Minimum of 16 hours of counseling

Up to 5 years probation

Ignition Interlock required for 6 months

Extreme DUI First Offense or BAC above .150

Jail: Minimum of 30 days in Jail / Maximum of 6 months.

Fines: $250 Base Fine plus surcharge, $250 assessment to the DUI abatement fund, $1,250 fee for Prison Assessment and $1,000 for Public Safety. Total fines approximately $2,700.

Driving Privileges90 Day License Suspension. After 30 days you can apply for a restricted license that allows you to drive to and from work, school and necessary appointments related to your DUI provided that you have an interlock device installed in your vehicle.

Driving Privileges90 Day License Suspension. After 45 days you can apply for a restricted license that allows you to drive to and from work, school and necessary appointments related to your DUI provided that you have an interlock device installed on your vehicle.

Multiple DUI Offense Penalties

The penalties for multiple DUI or receiving more than one DUI within a 7 year period are compounding and carry higher penalties than a first offense DUI of the same degree.

DUI Second Offense or BAC above .080

Jail: 90 days in jail with the possibility for 60 days suspended upon successful completion of alcohol screening and submission to treatment.

Fines: $500 Base Fine plus surcharge, $250 assessment to the DUI abatement fund, $1,250 for Prison Assessment and $1,250 for Public Safety. Total fines approximately $3,400.

Driving Privileges: One year driver’s license revocation. After 45 days you can apply for a restricted license that allows you to drive to and from work, school and necessary appointments related to your DUI provided that you have an interlock device installed on your vehicle.

Extreme DUI Second Offense or BAC above .150

Jail: 120 days in jail

Fines: $500 Base Fine plus surcharge, $250 assessment to the DUI abatement fund, $1,250 for Prison Assessment, $1,250 for Public Safety, and an additional $250 assessment.

Total fines approximately $3,700.

Driving Privileges: One year driver’s license revocation. After 45 days you can apply for a restricted license that allows you to drive to and from work, school and necessary appointments related to your DUI provided that you have an interlock device installed on your vehicle.

Super Extreme DUI Second Offense or BAC above .200

Jail: 180 days in jail

Fines: $1,000 Base Fine plus surcharge, $250 assessment to the DUI abatement fund, $1,250 for Prison Assessment and $1,250 for Public Safety and an additional $250 assessment. Jail costs for a second offense Super Extreme DUI can exceed $13,000 if not modified or waived by the judge.

Driving Privileges: One year driver’s license revocation. After 45 days you can apply for a restricted license that allows you to drive to and from work, school and necessary appointments related to your DUI provided that you have an interlock device installed on your vehicle.

Arizona Felony DUI Penalties

In the state of Arizona a DUI is considered a felony if any of the following criteria are met.

  • – 3rd Offense DUI within 7 Years
  • – DUI with license suspended or restricted
  • – DUI with a child under the age of 15 in the vehicle

The guidelines for Felony DUI convictions assume a clean felony record. Individuals with prior felonies with receive even stricter sentencing, harsher penalties and higher fines.

Felony DUI (3rd Offense DUI within 7 Years, or DUI with License Suspended or Restricted)

Prison: 4 months in prison minimum before eligible for release

Fines: Up to $150,000 in fines plus a surcharge and additional assessments

Driving PrivilegesThree year driver’s license revocation and possible vehicle forfeiture if you were driving a vehicle you owned during the arrest.

Up to 10 years of probation

Felony DUI (with a child under 15 years in the vehicle)

Jail or Prison: If convicted under this section an individual will have to serve at least the minimum sentence for the misdemeanor DUI offense but for the presence of a minor child.

Fines: Up to $150,000 in fines plus a surcharge and additional assessments

Driving Privileges: One year driver’s license revocation and possible vehicle forfeiture if you were driving a vehicle you owned during the arrest.

Up to 10 years of probation
